COBB Tuning Enters into Settlement Agreement with the EPA
This announcement is a formality. Changes that we’ve been required to make have been made for some time. Nothing is changing with the Accessport, Accessport functionality, or our product catalog. We’re excited to move forward and focus on the development of both existing and future platforms.

September 16, 2024 (Austin, Texas) COBB Tuning announced today that it has entered into a settlement agreement with the U.S. Environmental Protection Agency (EPA) over alleged violations of the Clean Air Act that occurred prior to August 28, 2017. EPA had alleged that COBB manufactured and sold certain aftermarket tuning devices, custom tuning software, and associated hardware packages which could be used to bypass, defeat, or render inoperative elements of a vehicles emissions control system. COBB has fully cooperated with EPA in its investigation of these claims and asserted to the EPA that COBB did not develop or market the products as emissions defeat devices. Further, COBB has provided documentation to the EPA verifying that it has successfully secured California Air Resources Board (CARB) Executive Orders (EO’s) or other third-party emissions certifications demonstrating that its entire product line, including all of the products included in the EPA Complaint, are compliant with emissions standards/regulations and the Clean Air Act.
After extensive discussions with the EPA regarding this matter, COBB has concluded that it is in the best interest of its customers, employees, distribution partners, and COBB to enter into this settlement agreement. In entering into this settlement, COBB does not admit to any liability regarding its products, conduct, transactions, or occurrences that have been alleged in the Complaint by the EPA.

Mr. King continued, “By entering into this settlement, called a Consent Decree, we will be able to dedicate more time and organizational resources to the future of the performance tuning/vehicle customization market, and our commitment to delivering reliable, fun, and emissions certified performance solutions to the automotive enthusiasts.
He concluded by saying “As a company, we take our emissions stewardship seriously, and proactively addressed in real time each area of concern that the EPA identified with how some of our legacy products could be used in an unintended manner. We had to make difficult choices along the way regarding how and when to make changes to or discontinue certain products that the EPA identified as concerning. We always focused our decision-making process on implementing changes in a way that had the best interests of our enthusiast customers, distribution partners, and the environment in mind. Sometimes those were tough choices, which required immediate action in order to address EPA concerns. I am pleased to report that those product changes are behind us, and both our customers and distribution partners can be confident purchasing COBB products. Our entire product line is fully emissions compliant. Our Power Packages and calibrations/tunes deliver exciting performance and drivability enhancements for our customers’ vehicles. So I have a Subaru WRX Limited 2017. It has the older model of the ethanol flex fuel kit. I’ve still been getting a low ethanol voltage that’s been going on for over a year now I have to reset my ECU about once a week, just wondering if this coming year, y’all have a solution for that I do have all my TGV deletes so I don’t know if you have a new kit that I can use for my car so it can run right I appreciate your time if you can get back to me as soon as possible thank you. Hey Matthew, we do not intend to offer a solution that would work with your configuration. That said, we are happy help you transition over to our newer CAN Gateway Flex Fuel solution. In order to do so, as you’re aware, you will need to reinstall the factory emissions equipment in order to utilize our products and tuning solution moving forward.

I just have a question about that. The mods I have are the intercooler offered by cobb with the charge air pipe to the turbo. stock intake air box, j pipe cat and tgv are still present. The accessport was purchased in 2022. what do i have to do to get my tunes EPA approved?
Hey Rus, great question! The short answer is “nothing”. Anything you purchased from us in recent years would either already have CARB EO coverage active or pending upon release. Now that the EPA is against the ropes, getting BTFU, and rolling back regulations. What can those of us that already have deleted vehicles, Cobb AP’s and haven’t been able to retune since the switch to the current GSI software versions, expect to see in the future?

Great question and this is definitely something we will continue to keep an eye on. To the best of our knowledge, even with the reduction of enforcement and funding, the laws themselves have not changed. Should the actual laws change in the future in a way that allows us to take action, we would absolutely evaluate a shift of our product offering.

Hi, I have a 2005 STi that has basically nothing stock in the engine bay other than the belt driven components. That said, I have a pro tune with over 800HP, and my Cobb AP is no longer connecting to the AP Manager to pull logs. I have deduced that it’s due to my firmware version (3.1.5). However, I am being warned that if I upgrade the AP firmware, that my tune will be locked in and not able to be modified. To be clear, my car is NOT registered for on-road use and is solely used for racing events. I have spent a lot of time and money on this car getting to where I am, and do not want to have to switch to AEM after I have invested so much time, energy and money into COBB. Can I update my AP without losing access to the old tuning features? Or am I just screwed? Thank you.
Hey Phil! Updating your Accessport’s firmware will NOT prevent you from using existing maps. One thing that I recommend is keeping a copy of your map file in a safe place (Google Drive, external HDD, etc.) in case you ever need access to it in the future. That way, on the off chance that your Accessport has some sort of failure you still have the ability to continue using your map after the Accessport is serviced/replaced.
